Starting from 1 August 2023, employees working for small business employers (employers with fewer than 15 employees) are entitled to 10 days of paid family and domestic violence leave within a 12-month period.

Keeping in mind, employees of larger employers (over 15 employees) already have access this leave type effective from 1 February 2023.

Here's what you need to be aware of regarding this leave:

  • The leave provides 10 days of paid family and domestic violence leave to employees of small business employers.

  • All employees, whether full-time, part-time, or casual, are eligible to use 10 days of paid family and domestic violence leave within a 12-month period.

  • The leave entitlement is not prorated for part-time or casual employees.

  • All 10 days of leave are immediately available.

  • This is a separate paid leave entitlement.

  • Employers are prohibited from including certain information about taking paid family and domestic violence leave on an employee's pay slip.

  • This new leave provision replaces the previous 5 days of unpaid family and domestic violence leave under the National Employment Standards.
